To imagine the scale of changes we can expect, consider this: streaming platforms are a medium to promote games. But a decade ago, streaming content from a game carried its own risk for the platforms that made it possible. Even Twitchs investors, Bessemer Venture Partners, estimated the likelihood Twitch will be sued by game publishers for copyright infringement at 15% .

Fast forward to today and voila Twitch is not sued by game publishers, instead, it is seen as a platform to promote games thanks to the streamers who play them. With that in mind, can we expect the same approach change comes to playing copyrighted music during streams?

What matters most, however, is that we should consider substance over form. As long as streamers are not acting in a DJ-esque capacity where music is the sole focus of a stream, streamers can essentially be seen as a platform that promotes music artists through their channel, no matter if you are playing music while streaming on Twitch, YouTube, or any other platform. Its a reciprocal relationship.

As we mentioned above, you are not allowed to play music that you do not have the rights to play. Play music without a license and youre violating copyright law. Twitchs Terms of Service and Community Guidelines explicitly say: You may not include music you dont own in your Twitch streams or VODs.

Currently, many Twitch streamers unintentionally violate the law because they want to give their audience the best experience possible. Unfortunately, including copyrighted music without proper licensing can result in takedowns and it denies musicians the funding they deserve. Music You Are Not Allowed To Use In Twitch Streams

On the other end of the spectrum is the strictly prohibited, copyright-claimed music. The confusing part is that most of the items on the list are counter-intuitive, for example, karaoke performances. And since many streamers tend to trip up on similar things, make sure you do your research before adding any of these to your stream:

  • Radio-style programs and listening shows. It doesnt matter if you came up with an original show you cant use copyrighted music unless its licensed to you or free use.
  • DJ sets. Sharing pre-recorded tracks that arent licensed to you is not allowed, even if youre mixing them.
  • Karaoke performances. Even if youre the one performing the song and it doesnt sound anything like the original, its still considered copyright infringement.
  • Lip-synching. If youre just pantomiming the song instead of singing it, its still prohibited unless you have proper licensing.
  • Visual representation of copyrighted music. This includes lyric videos, tablatures, or any other type of visual depiction.
  • Cover songs. Again, you need a license from the original performer or copyright holder if you want to cover a particular song. If you do it anyway, make sure not to include any recorded elements and perform the song as close to the original as possible.

Can I Play Spotify On Twitch

The answer is yes, but not all. According to the community guidelines on Twitch, there’re three types of music you can use on your stream:

1. Music Owned by You Original music which was written by you and either recorded or performed live by you, and for which you own or control all rights necessary to share the music on Twitch, including the rights to the recording, performance, and to the underlying music and lyrics. Please remember that if you have a contractual relationship with an organization that controls rights to the content you create, such as a record label or publishing company, you should make sure that you are not in violation of that relationship by sharing that music on Twitch.

2. Music Licensed To You Copyrighted music owned in whole or part by someone other than you, if you have secured a license to share it on Twitch from the relevant copyright holders.

3. Twitch Sings Performance A vocal performance of a song as captured in Twitch Sings gameplay, provided it is created in accordance with Twitch’s Terms of Service.

In a nutshell, you can only play songs that you own or don’t have copyright protection. You can play songs from Spotify, but only those songs that you own or aren’t copyrighted. And these are the types of music content you should avoid in your streams: radio-style music listening show, DJ set, karaoke performance, lip synch performance, visual music depiction, cover song performance.

A Common Misconception About Copyrighted Music

Copyrighted music is essentially any music that you don’t own the rights to broadcast.

So, I’ve seen some people saying that they pay for Spotify or Amazon Music or YouTube Music or any platform like that, but that is simply not the same.

If you pay for a subscription to Spotify, all that does is give you the license to be able to listen to that music on a personal device. It doesn’t give you the right to broadcast that music to other people across the internet, remember about it.

We’ve also seen a lot of people raising their pitchforks at Twitch, asking them why they’re issuing all of these copyright strikes right now. But really, Twitch isn’t at fault here. It’s kind of taken out of their hands. Sure, there’s plenty that Twitch could have done because the writing has been on the wall about this happening for the platform for a number of years now.

But in terms of actually what’s happening with these Copyright Management Acts takedown notices, and then a copyright strike, Twitch really isn’t at fault. Like pretty much every other platform out there, Twitch makes use of something called safe harbor, which is built into DIGITAL MILLENNIUM COPYRIGHT ACT, which essentially states that they are not responsible for the copyright infringement of users on their platform. But to be able to be protected, they have to follow a few different guidelines.
