What Are The Punishments
Twitch doesnt actually do a lot of enforcement of these rules during live streams. However, if they discover copyrighted songs in Video on demand footage, they will be very strict with the Digital Millennium Copyright Act and cover themselves by muting the video. The only way to actually get into problems, is if someone submits a DMCA-takedown while a streamer is live. This has happened before with more popular streamers and resulted in a 24H ban.
Where Do I Get Copyright
There are many copyright-free sources for music. Avoid trouble by steering away from using copyrighted audio.

Types Of Stream Safe Music

There are many types of music you can play on Twitch.
Copyright free music is a category of music which, for one reason or another, is not under legal copyright. This means that it can be played in Twitch streams. Public domain and Creative Commons music can also be played, although sometimes it will need to be credited.
Music libraries are another good option for finding stream safe music, and as mentioned before, we have our own free library of copyright-cleared music for easy and safe use in stream and video. Download songs from Music Cellar here, or check out this article for further information on finding good background music for streaming.
Stream-Safe music mode is a handy setting in Twitch that prevents copyrighted music from being streamed. A scenario where this could be used might be when live streaming a video game. Some games contain copyrighted music, so these sections would need to be muted, but for the rest of the stream the audience would want to hear the sound effects and dialogue. This setting protects streamers from accidentally violating copyright and receiving DMCA strikes.
This feature can be turned on in the stream settings, under âonly play stream-safe musicâ.

How To Avoid A Dmca Takedown On Twitch
While weve already covered the types of music you can and cant use, as well as recommended you obtain music licenses for any tracks you do use, there are ways that you, as a content creator, can avoid receiving a DMCA takedown.
Twitchs own advice on the best ways to avoid a DMCA takedown on the platform is as follows:
Dont play recorded music on your stream – Completely abstaining from using any recorded music is by far the simplest way to avoid a DMCA notification. Twitchs own guidance does point out that you dont have to do this if you own the rights or have the required permissions though. Music is central to the enjoyment of content, so though its a simple way to avoid DMCA issues, eliminating music all together could mean your content doesnt perform as well.
Mute in-game music – Many games have recorded music in them, and if youre streaming them live it may get picked up. While this is rare, you may want to check the End User License Agreement for the game youre playing. Some games may give you the option to turn off the music while youre streaming.
Check your old content on VODs and Clips – if you uploaded content before Twitch brought in its copyright rules youll need to check whether you have any videos that could see you get a notification. If you do, youll likely have to delete them, or youll need to try and seek permission for the songs included.

Dmca Strikes & Using Copyrighted Music
Twitch uses DMCA strikes to handle the process of punishing users for illicitly using copyrighted material. Each time Twitch detects an improper use of music, the specific section will be muted, the video may be suspended, and upon further violations, the account may be permanently banned.
DMCA Strikes
Channels which commit DMCA violations will be notified of their infringement and subsequent punishment via email, or when logging in to the website or software. It’s a three strike system:
- the first DMCA strike committed will result in a 24 hour ban to the Twitch channel
- the second strike will leave an account banned from 1â7 days
- the third strike results in the account being banned from Twitch forever.
These strikes stay on the account record permanently, so itâs best to avoid receiving them as much as possible.
Content Claims
Twitch has a system to report copyright infringement if an artist believes their work is being used illegally. These copyright claims will be made by the original owner of the material, which could be the artist, their record label or management, or even a fan.
Twitch also scans videos with an algorithm to automatically detect and remove copyrighted material. Sections of videos containing unauthorised audio will be muted.
Sometimes the algorithm makes mistakes and incorrectly mutes videos. In this situation an appeal can be made to Twitch to reverse the strike. For full details on appealing copyright claims on Twitch, see this page.
Angling For Bigger Tips
This is a big no-no when it comes to streaming. Some streamers have found that they can add donation buttons, which can ultimately turn some viewers off. When it comes down to it, unless a streamer has a solid reputation, viewers are there to watch someone else play a video game. Theyre not logging onto an account to donate money or tip a gamer whos not well-known, and its certainly not impressive asking for them to do so. This can be much more hurtful than it is helpful.

Are You Allowed To Play Music On Twitch
Twitch and music. It can be summarized in one word confusing. The majority of streamers that play music in their streams do so with little regard for copyright law. However, Twitch recently issued several DMCA takedowns and effectively prevented streamers from using the platform if they continue playing music they dont have the rights to.
Its not uncommon to find streamers playing todays top hits or yesterdays classics. Streamers sometimes also take song requests, giving their audience control of the music. In the past, the music industry hasnt taken action but thats changing. Just last year, many popular streamers were hit with 24-hour bans on the platform for playing copyrighted music. So what are the rules? The punishments? And what can you do to protect yourself?
What were seeing right now, not only on Twitch but on most streaming platforms, is an increased eagerness to respect copyright laws. People realize that creators intellectual property needs to be prioritized, for obvious reasons. However, listening to your moral compass does not mean you cant or shouldnt play music in your streams. You are allowed to play music on Twitch as long as you follow the rules. Lets get into it.

Music You Are Not Allowed To Use In Twitch Streams
On the other end of the spectrum is the strictly prohibited, copyright-claimed music. The confusing part is that most of the items on the list are counter-intuitive, for example, karaoke performances. And since many streamers tend to trip up on similar things, make sure you do your research before adding any of these to your stream:
- Radio-style programs and listening shows. It doesnt matter if you came up with an original show you cant use copyrighted music unless its licensed to you or free use.
- DJ sets. Sharing pre-recorded tracks that arent licensed to you is not allowed, even if youre mixing them.
- Karaoke performances. Even if youre the one performing the song and it doesnt sound anything like the original, its still considered copyright infringement.
- Lip-synching. If youre just pantomiming the song instead of singing it, its still prohibited unless you have proper licensing.
- Visual representation of copyrighted music. This includes lyric videos, tablatures, or any other type of visual depiction.
- Cover songs. Again, you need a license from the original performer or copyright holder if you want to cover a particular song. If you do it anyway, make sure not to include any recorded elements and perform the song as close to the original as possible.

No matter the sort of content you produce for Twitch, adding background music to the intro, outro or throughout your stream can help make your content more engaging and fun for your viewers. But we get it you dont want to get a pesky DMCA strike on your account, so how do you add music to Twitch streams that is DMCA free?
Weve put together this comprehensive guide to help you navigate the tricky world of music licensing and copyright bretches to ensure you dont get caught out. As the biggest streaming platform in the gaming sphere, Twitch is the go-to place for anyone wanting to make a career out of streaming.
Publically Calling Out Lurkers
This is not a written law by Twitch, but it is a highly respected unspoken guideline put in place by both viewers and streamers. Viewers trust their favorite streamers enough to not call them out if theyre lurking, an otherwise poor name for those who enter a stream simply to watch and not to interact. Theres absolutely nothing wrong with this as some people may just have anxiety or shy away from interaction, but a problem arises when streamers call out someones username for doing it.

Twitch And Audible Magic
Twitch has been working with Audible Magic to implement a system that will automatically remove unauthorized third-party audio from Videos on Demand . The VOD is an archive of content previously streamed live on Twitch, otherwise known as Clips,Highlights, and Past Broadcasts.
The company hopes this will protect both broadcasters and copyright owners. However, this technology wont scan live broadcasts.
Twitchs guidelines for audio content havent changedlist of what is and isnt allowed can be found on the companys community guidelines website. Regardless, the addition of an automated scan and takedown process might result in the unexpected removal of older VODs. This doesnt reflect a change in policy, but rather, just a change in enforcement.
